Debian ships fdupes with a patch, which makes it possible to replace duplicates with hardlinks.

I'd love to see this patch also to be shipped by Gentoo.
Is it against any policies to add patches which add extra functionality to an ebuild?

So our policy is not s strict. Actually it depends on the maintainers will to maintain these patches.
I took a look at the debian report, but could find the corrected patch in their repositories. could you point me to it?

Well, me neither… weird.
As I found out, there are other tools in portage (e.g. app-arch/hardlink) which can do the same, I'll close this as WONTFIX.
