omrb ~ # /etc/init.d/syslog-ng restart

syslog-ng: Error creating pid file; file='/var/run/syslog-ng.pid', error='Permission denied'                   

so syslog-ng was started but init script failed

Works fine for me.  Attach your config files and the init.d script you're using please.
