I have not tried running the ebuild against a gentoo kernel, but I am fairly certain that compiling the unpatched source fails with all newer kernels.

Reproducible: Always

Steps to Reproduce:
1. Use any newer kernel, say 2.6.31
2. emerge acx
3. compile fails

Actual Results:  
compile fails


Expected Results:  
compile failed -- when I use the patched source here, I get a good compile

Note that I have submitted patched source which solves the problem

Mike please provide emerge --info net-wireless/acx
Please test against a Gentoo kernel and provide the build log.

The latest ebuild did compile correctly against 2.6.32 gentoo kernel.  I think a patch has been added since I last reviewed this.  Sorry.  Thanks a lot.
