Bug 29629 – baselayout-1.8.6.10-r1 cannot copy /dev/pts/.keep

When emerging baselayout, there is an error when trying to copy to 
/dev/pts/.keep 
 
And the install aborts.  This is especially problematic in baselayout. 

Reproducible: Didn't try
Steps to Reproduce:
1. emerge baselayout 
 
Actual Results:  
Error 

Expected Results:  
Cleanly installed 

I do not use devfs or devfsd, which has been assumed by ebuilds in the past. 
 
I had the actual error text in a bug report, but I've been having problems with 
bugs.gentoo.org (Bug 29628), and it's scrolled out of my screen now; basically 
just a copy permissions error. 
 
I may be able to reproduce if I can get some reliable advice on safely fixing some 
current baselayout problems.
