emerging at-drivers (9.8) it's saying that a kernel > 2.6.30 is not supported.
Is there a patch?

Nope. Try ati-drivers-8.660, they're ati-drivers-9.10-alpha in disguise, so more buggy but more squishy. Wait for 9.10 for official support.

Take a look at #284549 (I haven't found Your bug two days ago).
Same for ati-drivers-9.9
