We filed this bug report on the apache bugzilla:
  http://issues.apache.org/bugzilla/show_bug.cgi?id=31858

Someone has posted a correct patch which fixes the problems. I believe it is worth it to apply this patch to portage as it affect many aspects of apache including mod_rewrite and <FilesMatch>.

It should be noted that this is also repotred upstream in Apache PR 31858:
