If it is possible, the non-free mpg123 could be replaces with the free mpg321.
mpg321 allows run-time switching of output device and is also free for
commercial use. Both of these are significant improvements over mpg123. mpg123
licence says it "may not be sold for profit" which could cause CD resellers
problems.

Steps to Reproduce:
If you do this take note of the hackery that i did on libao to make alsa output
work for mpg321. It has limited tested and zarro feedback.
mpg321 is now in the tree, but we will be keeping mpg123 too.
OK, the issue seems to be that mpg123 is "free for non-commercial use," so it's
not legally usable by some people. We should try to replace it with mpg321, and
make mpg123 an option. Reopening the bug.
I'd like to request that at least mpg123 and mpg321 use a common virtual
if mpg123 is going to be kept in portage then.
I have gentoo consistently trying to reemerge mpg123 when mpg321 properly
plays my mp3s and has a symlink to /usr/bin/mpg123 anyway.
It looks like the virtual is already in profiles/default/virtuals...
But the mpg123 and mpg321 ebuilds haven't been updated to PROVIDE it. Daniel, were you in the process of doing this a while ago? Was there any reason for this discrepency?
No response... so I'm gonna take this bug...
ok, the PROVIDE's have been added to both packages... how should I handle
getting the virtual into all the ebuilds? Should I do it myself, send mail to
individual maintainers, or just send a mail to -dev, hope for the best, and
check again in a week or so to see who listened?
Mailing -dev, then filing bugs against noncompliant packages in a week or so
would be a good idea.
The following packages still have media-sound/mpg123 references... my bad on
not updating the media-sound ones yet. I'll update sound@g.o's packages first
then send out a reminder email...
