By installing the Licensed Program on a Computer (as defined in Section 1), each recipient of the Licensed Program (hereinafter "Recipient") indicates agreement with the terms of the License. Section 1: Definitions The following terms shall each have the corresponding meanings listed below when used in this License. 1. A "Derivative Program" is the result of Modifications, Design Alterations, or other addition to, removal from, or alteration of any part or the entirety of the Licensed Program; changes to font information such as the font name or tables including font layout information; or addition, alteration, or removal of any or all font outline or bitmap data. 2. An "Independent Program" is a newly created digital font program or other derivative work which is created not by using any part or the entirety of the Licensed Program as is, but by extracting some or all of the character data or by making alterations to that data. 3. "Digital Media" refers to media in a digital data format distributed to end users, and includes without limitation media containing video data (video works or programs made from motion or still images and displayed or projected), text, images, or drawings. 4. A "Digital Document File" is a PDF or other document file created by software which includes part of the Licensed Program embedded in the file. 5. A "Modification" is a change to the structure of the font, including without limitation the creation of new characters by splitting off part of a Chinese character or by changing the shape of part of a character. 6. A "Design Alteration" is the addition of a display effect or a limited change in shape which does not change the structure of the font, including without limitation font effects used in application software (bold, italic, shadow, underline, outline, relief, etc.) and changes in character shape. 7. The term "Computer" shall include servers for the purposes of this License. 8. "Copying and Other Use" means copying, transferring, distributing, lending, transmitting to the public, and/or displaying to the public. Section 2: Usage Rights IPA hereby grants Recipient the right to use the Licensed Program worldwide under the terms of this License. However, IPA retains all rights in the Licensed Software. This License is not to be construed as granting Recipient any rights in the Licensed Program or any trademarks, brand names, or service marks. 1. Recipient may install the Licensed Program on storage media and use it on any Computer under the terms of this License. 2. Recipient may use the Licensed Program for text and other expression in printed works and Digital Media. 3. Recipient may use software programs or other methods to apply Design Alterations and Modifications to the Licensed Program, then used the result for text and other expression in printed works and Digital Media. 4. Recipient may make Copying and Other Use of the printed works or Digital Media produced under paragraphs 2 and 3 above, regardless of whether the work is commercial or whether it is used in broadcast, communication, or other media or form. 5. For any work of Digital Media, Recipient may embed the subset of characters used in that work to create a Digital Document File under the terms of this License, and may make Copying and Other Use of that Digital Document File. Recipient is not required to bind recipients of the Digital Document File to the terms of this License. 6. Recipient may distribute, whether commercially or otherwise, the Licensed Program to a third party under the name "IPA Font", provided that no Modifications, Design Alterations, or other changes are made to the Licensed Program. However, Recipient must also provide a copy of this License when distributing the Licensed Program to a third party. 7. Recipient may create Derivative Programs or Independent Programs for personal use or research purposes. Section 3: Restrictions The usage rights granted in section 2 are subject to the following restrictions. 1. Recipient must not distribute Derivative Programs or Independent Programs, whether commercially or otherwise, without the permission of IPA. 2. Recipient must not change the name "IPA Font" when distributing the IPA Font under paragraph 6 of section 2. 3. IPA carries no liability with respect to Derivative Programs or Independent Programs created by Recipient. 4. IPA carries no liability for damages suffered by Recipient due to the Licensed Program, Derivative Programs, or Independent Programs, including but not limited to liability for repair costs, data loss, loss of use, profit, goodwill, or property, or other special, indirect, or consequential damages. 5. IPA makes no warranty and provides no technical or user support for the use of the Licensed Program, Derivative Programs, or Independent Programs. Section 4: Termination 1. This License comes into force upon execution, and shall terminate when Recipient uninstalls all copies of the Licensed Program from all Computers. 2. Regardless of the previous paragraph, this License shall terminate immediately and automatically upon violation of the License by Recipient, and Recipient shall henceforth cease all use of the Licensed Program, Derivative Programs, and Independent Programs. Recipient shall be liable for any damage caused to IPA through violation of the terms of this License. Section 5: Governing Law 1. This License may be changed from time to time. When this License is changed, Recipient may choose between the previous and the new version of the License when distributing the Licensed Program. All matters not explicitly stated in this License shall be determined in accordance with the Copyright Law and related laws. 2. This License shall be interpreted according to the laws of Japan.
