This should be trivial to fix. AMD likes to make trivial changes to the code so the patch needs to be rebased :|
I just tested ati-drivers-12.6_beta on hardened-sources-3.4.2. It works with USE=-pax_kernel (= emerge + reboot + running opengl stuff), which means this patch is no longer needed. So no rebasing necessary. :)

I have same problem at stable 'amd64/no-multilib' with 3.3.8-gentoo kernel USE=-pax_kernel do not helping me - X is crash with it :(

The WARN patch is needed just to compile the kernel module against an hardened kernel, it does not add any compatibility between the two. Likely you have a configuration problem, but if you think your config is correct open another bug
I'm being bitten by this bug, too, but with the recently stabled ati-drivers-12.6.
Patch removed from 12.6 and 12.6_beta_pre897
