This should be trivial to fix. AMD likes to make trivial changes to the code so the patch needs to be rebased :|

I just tested ati-drivers-12.6_beta on hardened-sources-3.4.2.
It works with USE=-pax_kernel (= emerge + reboot + running opengl stuff), which means this patch is no longer needed.
So no rebasing necessary. :)

I have same problem at stable 'amd64/no-multilib' with 3.3.8-gentoo kernel

USE=-pax_kernel do not helping me - X is crash with it :(

Your issue is different by the one described by this bug. The WARN patch is needed just to compile the kernel module against an hardened kernel, it does not add any compatibility between the two. Likely you have a configuration problem, but if you think your config is correct open another bug

I'm being bitten by this bug, too, but with the recently stabled ati-drivers-12.6.
