According to http://ipset.netfilter.org/install.html ipset 3.0 supported only with iptables 1.4.4 and above. Therefore there must be dependency in ipset ebuild. Else we have following error when starting iptables:
falcon-cl4 ~ # /etc/init.d/iptables start
 * Loading iptables state and starting firewall ...
iptables-restore v1.4.3.2: Problem when communicating with ipset, errno=71.
