This seems to be a problem only if tests are run with FEATURES=userpriv. Running emerge as root or outside portage causes all tests to succeed.
could you please try with media-gfx/imagemagick-6.5.1.0 and post the output of `emerge -pv imagemagick` please? I've run the tests with FEATURES="userpriv" here w/o problems.

(In reply to comment #5) > imagemagick-6.5.1.0 hasn't run tests and emerged (build log follows). you have to emerge imagemagick twice to run the tests (this means you have to re-emerge the imagemagick-6.5.1.0 version. (I should add an einfo to the ebuild...)

when USE="perl" is set, userpriv will be restricted - so the tests should run w/o problems. thanks for the investigation on this! *imagemagick-6.5.2.7 (24 May 2009) 24 May 2009; Markus Meier <maekke@gentoo.org> -imagemagick-6.4.8.3.ebuild, -imagemagick-6.4.9.2.ebuild, +imagemagick-6.5.2.7.ebuild: version bump, RESTRICT userpriv when perl USE-flag is enabled wrt bug #269448, fixes bug #269987, improve message in src_test, remove old
