Removing the patch line from the ebuild works, seems the line of code (line 981 in libs/libmythtv/NuppelVideoRecorder.cpp) from the patch doesn't even exist anymore when changing the path of the files to fix the initial patch error. I do not have a bttv card to verify if everything still works after removing the patch.

Not sure if the patch is still needed (not experienced enough to verify).

The changelist from upstream references http://svn.mythtv.org/trac/ticket/5608 , which seems like a duplicate of the issue fixed by the gentoo bttv patch with a similar fix. It looks like it should be safe to just ditch the gentoo patch.
Voting for this, as this version contains a patch that makes DVB work with kernel 2.6.28.

Hi guys, I just got this error after an update this morning. You guys are awesome, so fast on the bug report! :) I commented out the patch in the ebuild and it built without an issue (this latest package also fixes the 2.6.28 build problem). My backend is running fine and all seems good from some basic testing. Unfortunately I don't have a "bttv" card, so I'm not sure if my comment is helpful. Good job on the fast work here, your efforts are appreciated. Cheers.
Same problem here. Will wait for the comment-out-bttv-patch patch. ;) Hopefully we'll get a bump on all the plugins and mythweb soon, since many of the fixes in this SVN changeset are for them alone.
I just updated (after commenting out the bttv patch) and my bttv card works just fine.

my bttv (bt878-dvico Fusion HDTV Lite) card does not work after commenting out the patch, and is reporting no signal.. My cx23885 card still does work
