You say you have sent it upstream? May I ask where? (I cannot see it in the sourceforge bug/patch tracker)

Okay :-) I have just commited 1.4.4-r1 to the tree, could you please do a cvs up, try if it works on Gentoo/FreeBSD, and then keyword it?
Keyworded, I changed the replace-flags to append-flags to make it works also if user has not CFLAGS set since the configure.ac defaults it to -O2 that does not work. I hope I can found the problem and fix it asap so I can remove that workaround. Thanks
Updated ebuild to version 1.4.5 (contains your patch) and tested it on my Gentoo/FreeBSD system, compiles fine. Please test and reopen if it doesn't work for you. (Should have hit the tree by now)
